Product specifications

  1. We have a policy of continuous product development and reserve the right to amend the specification of products without prior notice in relation to future sales.
  2. Goods supplied may differ from those on display or advertised. Unless agreed with you, the goods supplied will be of equivalent value, functionality and appearance. Any significant variations will be highlighted on the display model.
  3. Leather goods are made from quality natural leather and accordingly they may not be uniform in colour or texture. Only the finest hides are selected but they will show natural marks and scars on the hide. Some leathers will mellow with age and exposure to sunlight and heat.
  4. We will endeavour to match the colour and texture of the fabric of your sofa to the samples chosen as accurately as possible, but variations in both the colour and texture may occur. All fabrics will fade to some extent following exposure to sunlight and heat.
  5. Some self-assembly may be required on certain products.

Measurements

  1. The client must ensure that furniture ordered can be delivered into your property and that there is safe and reasonable access from the public highway to the place of delivery. Awkward access deliveries such as hoisting, removing window frames and doors are priced on request. Please call us to arrange for an access check prior to delivery, but you will incur an additional charge for this service.
  2. The measurements of all furniture and furnishings made by us will be as accurate as possible but are nevertheless approximate.

Prices

  1. All prices quoted include VAT or allowance for VAT, where appropriate, at the prevailing rate and are subject to any promotional offer or discount.
  2. We reserve the right to modify any prices and models. Our pricelists and catalogues are updated annually. Models which are not included in the lists or catalogues, are no longer produced. We reserve the right to modify any forms, dimensions and design in order to guarantee the quality of our products.

Payments

  1. All orders, whether custom-made, currently in our warehouse or in transit must be paid for in full before delivery. We request a 40% advance deposit at the time of order placement. We will not commence manufacturing, nor reserve stock items without advance payment. The remaining 60% is due when the goods arrive at our warehouse and/or are ready for delivery. Only when we have received the balance of any monies due in cleared funds, and settlement of full payment order, will our logistics company be able to confirm your actual delivery date.
  2. All collection charges are at the buyer’s expense. Non-observance of a due date for payment will allow us to make all invoices collectable at once. Failing payment of the invoice by its due date, interest will, as of right, be due by the debtor as follows : for B2C transactions, the interest will not exceed the legal rate. For B2B transactions, the interest is 12% per year. Furthermore, we reserve the right to break off the whole sale, as of right, in case of non-payment of any partial delivery. In case of non-payment on the due date because of negligence or ill, the due amount will, as of right, be increased by 20%, subject to any charges, as a conventional penalty clause, with no formal notice required. For B2C transactions, the unpaid due amount will be increased by 5% . Moreover, the law of 2 August 2002 implemented to counteract delays in payment in business transactions, shall fully apply to any unpaid invoice, in particular with regard to the term of payment (if a departure from the general regulation of cash payment was agreed upon), interest on arrears (reference interest rate increased by 7 percentage points and rounded up to the higher half percentage point) and indemnity for collection charges.

Delivery

  1. Once your order has arrived at our warehouses, our logistics company will contact you to arrange delivery. We must be able to deliver the furniture into your home within 6 weeks thereafter. If we are unable to do so due to your default, our logistics company will make a charge for storing the furniture beyond this point, which is payable in advance. They will advise you of this charge at the relevant time, or you may of course elect to receive delivery.
  2. We will endeavour to offer next week delivery of stock items depending on delivery address and the availability of our delivery company. Stock orders can also be made available for collection within 24hrs. For next week delivery or collection at our warehouse, orders must be placed before midday, and you should discuss with a member of staff at the point of purchase.
  3. Standard delivery is to third-floor only (see Clause 5.4), includes assembly of the furniture and removal of packaging (which is taken away by our delivery team to be recycled). All deliveries are carried out by insured and qualified professionals. A two-to-three-hour delivery window is given as standard. Delivery charges will be confirmed depending on the location, floor and other relevant logistics arrangements needed.
  4. If you are unable, for whatever reason, to take delivery of your goods on the confirmed delivery date, we reserve the right to charge you further for any subsequent deliveries.
  5. You are responsible for providing a safe and reasonable means of access from the public highway to the place of delivery. If our delivery staff considers that access is unsafe, then we will not deliver the goods until safe access is provided. You are obliged to provide any required parking permits in advance.
  6. Deliveries are undertaken by a third-party carrier. Gregoir Lifestyle BV remains fully responsible for the smooth delivery and installation of your order. Any claims or disputes regarding the delivery and installation of your goods must be dealt with Gregoir Lifestyle BV at the time of delivery itself.
  7. Time of delivery is not of the essence in these Terms and Conditions of Trading. We will not be liable for any direct or indirect loss of profits or other financial loss or damage suffered by you through any reasonable delay or delay due to unforeseen circumstances outside of the reasonable control of Gregoir Lifestyle BV or delay due to any reasonable rescheduling of delivery.

Returns and Refunds Policy

Items cannot be refunded or returned. Please refer to Clause 5.6 for any claims and disputes and our Warranty policy for more details.

Warranty

  • The provisions of this clause 7 apply in addition to your statutory consumer rights in relation to faulty or mis-described goods. These rights are not affected by the warranty.
  • Warranties may not be transferred and are valid in country of original purchase/shipment.
  • CAMERICH is subject to all limitations and exclusions described in these Limited Warranties. The following CAMERICH products and parts are warrantied against material and manufacturing defects for the duration upon delivery set forth next to that product or part in the table below:

  • Limitations and Exceptions
    • The following limitations and exceptions apply to the Limited Warranties:
    • All warranties, whether express or implied, cover only normal household usage. They do not apply to defects or damage resulting from negligence, abuse or misuse ‒ including but not limited to inadequate or improper maintenance, exposure to water, chemicals, accidents or any use for which the product was not designed, nor do they cover ordinary wear and tear.
    • These Limited Warranties do not apply to any products that have been altered by any person, dealer or company without the express written authorization of CAMERICH.

Claims Under Warranty

  1. In the event of a claim under warranty occurring, please contact us at info@gregoir.com with the following information:- your sales invoice number, your address and contact details and a summary of the problem, including photographic evidence where appropriate.
  2. We will endeavour to repair the defective goods free of charge, where possible. If a repair is not possible you will be offered a replacement and only if a suitable replacement is not available will you be offered a refund.
  3. We will not be liable for any direct or indirect loss of profits or other financial loss or damage arising out of defective, damaged or wrongly delivered goods, over and above the value of the goods themselves. This does not affect your statutory rights.
  4. Our warranties are limited to goods sold and retained by Gregoir Lifestyle BV in Benelux, France and Germany, and exceptionally other EU Countries and used solely for private and domestic purposes.

Ex-Display and Clearance Items

You should thoroughly inspect any Ex-Display or Clearance Item prior to purchase. No refunds or exchanges are possible on items bought during sales.

Order Arrival Dates

  1. Order arrival dates quoted are estimated only unless otherwise agreed.
  2. CAMERICH products are exclusively distributed by Gregoir Lifestyle BV (Company ID VAT: BE 0437043101) across Benelux, France, and Germany. Gregoir Lifestyle BV will not be liable for any direct or indirect loss of profits or other financial loss or damage suffered by you through any reasonable delay or delay due to unforeseen circumstances outside of the reasonable control of Gregoir Lifestyle BV or delay due to any reasonable rescheduling of delivery. This includes manufacturing delays, shipping delays and delays due to customs clearance. If you have a particular deadline, please discuss this at the point of ordering with a Sales Representative. Delivery dates cannot be booked in until orders have arrived and been unloaded at our Belgian Warehouse and have been paid for in full.

Agents & Representatives

Our agents and their representatives are not authorised to collect our invoices, except with our express consent. Payment in their hands shall not exonerate the customer. Any promises or pledges made by the latter, are not binding on our company, except when confirmed by us.

Court of Law

  • Any disputes or contests, for whatever reason, shall be governed solely by the court of Antwerp (applicable for B2B customers).
  • All contracts are concluded on the aforementioned terms, any terms of purchase of our customers will not be acknowledged when these terms are incompatible with the aforementioned conditions.
  • Our written consent is required for any advertising with our models in magazines, dailies and weeklies, etc. – print and online.
